Civil Matters

Civil Disputes/Litigation

Our office can represent clients in various civil cases in California State Superior Courts and Federal Courts. Our goal is to assist clients in resolving the dispute. We provide legal counseling and analysis to assist the client in making informed decisions before and during litigation. We offer several fee arrangements, including reasonable hourly fees, retainer plus contingency fee, and in some cases flat fee agreements. After a consultation, we will be able to assess which fee arrangement. Some of the civil matters we handle are as follows:

  • Breach of contract
  • Civil Fraud
  • Construction defects
  • Defense of uninsured motorist cases
  • Insurance claims: theft, destruction of property, bad faith, coverage disputes, liability claims in excess of policy, Cumis counsel, punitive/exemplary damages

We also offer various legal services for the trucking industry. We represent and advise multiple trucking companies and independent owner-operators with matters related to: insurance claims, cargo losses, bond claims, Department of Transportation (DOT) compliance reviews and notices, disputes with independent owner-operators, negligent repair by a mechanic, defective tractors or trailers, and lawsuits involving claims in excess of applicable insurance policies. If you or your company is served with a complaint for damages, or are thinking of pursuing a claim, contact our office right away. We can also provide paymaster services.

Things you should do after an accident:

  • Insist that a report be filed with the police, sheriff or highway patrol.
  • Obtain the name, address, insurance information, vehicle license number and driver’s license number of any and all other persons involved in the accident.
  • At the scene have the person that hit you write that he/she is sorry and the accident was his/her fault. Preferably, the paper should be signed and dated.
  • Get the names, addresses and telephone numbers of all witnesses. This is important even if the person that hit you admits that he is at fault.
  • Photograph the accident scene, including all vehicles involved (before repairing) and any visible injuries (cuts, bruises, etc.).
  • Do not give any information about the accident to an insurance adjuster without seeking legal advice from your lawyer.
  • Do not give a recorded statement to an insurance company unless you speak with an attorney first.
  • Do not sign anything without consulting a lawyer. Truthful statements made in an attempt to be helpful can easily be misinterpreted and turned against you.
  • Seek medical attention and tell your physician or medical provider exactly how the injury occurred, describe all symptoms and complaints, and tell the doctor about any relevant past medical history.
  • Be sure to report memory problems, confusion or disorientation, however minor these things may seem at the time.
