Things you should do after an accident:

  • Insist that a report be filed with the police, sheriff or highway patrol.
  • Obtain the name, address, insurance information, vehicle license number and driver’s license number of any and all other persons involved in the accident.
  • At the scene have the person that hit you write that he/she is sorry and the accident was his/her fault. Preferably, the paper should be signed and dated.
  • Get the names, addresses and telephone numbers of all witnesses. This is important even if the person that hit you admits that he is at fault.
  • Photograph the accident scene, including all vehicles involved (before repairing) and any visible injuries (cuts, bruises, etc.).
  • Do not give any information about the accident to an insurance adjuster without seeking legal advice from your lawyer.
  • Do not give a recorded statement to an insurance company unless you speak with an attorney first.
  • Do not sign anything without consulting a lawyer. Truthful statements made in an attempt to be helpful can easily be misinterpreted and turned against you.
  • Seek medical attention and tell your physician or medical provider exactly how the injury occurred, describe all symptoms and complaints, and tell the doctor about any relevant past medical history.
  • Be sure to report memory problems, confusion or disorientation, however minor these things may seem at the time.
